1.      www.mydesiroots.com (also referred to as ‘The Company’) is a trade/brand name of ESP Well Being Pvt Ltd (hereinafter referred to as ‘the Company’), a company incorporated in India with its registered office in the state of Haryana.

 

2.      The General Terms and Conditions below apply to all offers and transactions of the Company (www.mydesiroots.com).

a.      Prices are subject to change, at the exclusive discretion of the Company.

b.      By accepting an offer or placing an order, the consumer expressly accepts the applicability of these General Terms and Conditions.

c.      Deviations from that stipulated in these Terms and Conditions are only valid when they are confirmed in writing by the management of the Company.

d.      All rights and entitlements stipulated for The Company in these General Terms and Conditions and any further agreements will also apply for intermediaries and other third parties deployed by The Company.

 

3.      DEFINITIONS: Certain words, terms or expressions used in this document shall have the meaning ascribed below:

a.      Third party(s) – The independent service providers, vendors including Priests, suppliers of goods or services who are transacting through the Company with the users on a principal to principal basis.

b.      Users or service recipients – Customers who are availing the services of the company and the third parties.

c.      Any term or word not defined in the document shall have the meaning that reflects the intention of the company while undertaking the transactions.

 

4.      QUALITY: The company guarantees that all the products offered meet the standards of the concept. If there are any complaints the management needs to be informed immediately in writing. Appropriate actions will be taken as soon as possible.

 

5.      PRICES/OFFERS

a.      All offers made by The Company are without obligation and The Company expressly reserves the right to change the prices, in particular if this is necessary as a result of statutory or other regulations.

b.      All prices in order summary are indicated in your local currency/ US$, including taxes and other applicable charges.

c.      In certain cases, promotional prices apply. These prices are valid only either during a specific period, or as long as stocks last. No entitlement to these prices may be invoked before or after the offer.

d.      The Company cannot be held to any price indications that are clearly incorrect, for example as a result of obvious typesetting or printing errors. No rights may be derived from incorrect price information.

6.      PAYMENTS

a.      All prices include taxes and other applicable charges. However, they exclude and accessories, raw material or tools that may be required to perform the select service.

b.      Methods of payment that we accept: Debit/ Credit Cards (Visa, Mastercard and American Express) and select Wallets/ UPI Gateways as applicable in your region. Other modes, like bank transfers, could be considered upon special requests.

c.      All payments must be made in advance while placing the order. You will not receive confirmation of your definitive order until your payment has been approved.

7.      OTHER PROVISIONS:

a.      If one or more of the provisions in these Terms and Conditions or any other agreement with The Company are in conflict with any applicable legal regulation, the provision in question will lapse and be replaced by a new comparable stipulation admissible by law to be determined by The Company

b.      The law applicable at New Delhi (India) applies to all agreements entered into with or concluded by The Company. Any disputes arising directly or indirectly from these agreements will be exclusively settled at the relevant Court in New Delhi (India).

8.      Shipping/ Delivery:

a.      All orders shall be delivered as per the schedule defined in the order confirmation.

b.      Additional delivery/ shipping charges may apply as per the service/ product booked.

c.      The Company shall not be responsible for any delays because of any unforeseen circumstances like state/ country specific restrictions, curfew, roadblocks or any other.
